Welcome to Infinishot AI! These Terms of Service ("Terms") govern your use of our website (infinishot.com) and services (collectively, the "Service") operated by Infinishot AI ("Infinishot," "we," or "us"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. Service Overview

Infinishot AI allows users to upload photos of their face to generate high-quality business headshots using artificial intelligence. Users must create an account using their email address and receive a one-time password to log in. The Service includes a free trial package and various paid options, as described below.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years old, have not been previously suspended or removed from the Service, and that your registration and use of the Service comply with all applicable laws and regulations.

3. Accounts and Registration

To use the Service, you must create an account by providing your email address. A one-time password will be sent to your email for login purposes. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

4. Free Trial and Paid Packages

4.1 Free Trial

Infinishot AI offers a free trial package that allows users to generate up to 8 business headshots. There is no obligation for availability, generation speed, or quality of the Service. The free trial offer can be discontinued or modified at any time without prior notice.

4.2 Paid Packages

Users can purchase various paid packages, which include features as specified at the time of purchase. Once a package is purchased, any subsequent changes to the Service or its features will not affect previously made purchases. Users are encouraged to try the free trial package to evaluate the Service.

4.3 Money-Back Guarantee

Infinishot AI offers a voluntary money-back guarantee for paid packages. This can be claimed within 7 days of purchase if none of the generated images have been downloaded in full quality. To claim the guarantee, users must contact refund@infinishot.com within the specified period, providing the customer and order details.

5. Photo Upload and Generation Quality

5.1 Photo Upload

Users can upload their own photos to the Service. These photos are used solely to generate application images. By uploading photos, users grant Infinishot AI the right to process and use these photos for the purpose of generating headshots.

5.2 Generation Quality

The quality of the generated headshots can vary due to the technology used and its inherent non-determinism. There is no guarantee of accurate or usable results. Users are encouraged to use the free trial package to assess the Service. Infinishot AI is not responsible for variations in image quality.

6. User Rights and Data Deletion

6.1 User Rights

Users are granted a permanent and unconditional right to use all generated photos for personal and commercial purposes. This includes public distribution on social networks and use in marketing materials.

6.2 Data Deletion

Users can delete individual shoots in the shoot view or delete their entire account in the profile settings. Upon deletion, all user data, including generated images, will be permanently and irrevocably deleted. This applies to both free and paid shoots.

7. Digital Watermarks and Misuse

7.1 Digital Watermarks

Generated images may include an invisible digital watermark. This watermark helps us protect our rights and prosecute any breaches of contract.

7.2 Misuse of Service

Infinishot AI reserves the right to block accounts at any time if misuse of the Service is suspected. Misuse includes, but is not limited to, unauthorized sharing of generated images, uploading inappropriate photos, or any activity that violates these Terms. If an account is blocked, further generation of photos may be restricted, but users will still be able to download photos that have already been generated.

8. Privacy and Data Protection

8.1 Data Collection

Infinishot AI collects and processes personal data in accordance with our Privacy Policy. By using the Service, you agree to the collection and use of your data as described in the Privacy Policy.

8.2 Data Security

We implement reasonable measures to protect user data from unauthorized access, alteration, disclosure, or destruction. However, no method of transmission over the Internet or method of electronic storage is completely secure, and we cannot guarantee absolute security.

9. Limitation of Liability

To the fullest extent permitted by law, Infinishot AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Service; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from the Service; (d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Service by any third party; (e) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service; and/or (f) the defamatory, offensive, or illegal conduct of any third party.

10. Dispute Resolution

10.1 Informal Resolution

Before filing a claim against Infinishot AI, you agree to try to resolve the dispute informally by contacting us at support@infinishot.com. We will try to resolve the dispute informally by contacting you via email. If a dispute is not resolved within 30 days of submission, you or Infinishot AI may bring a formal proceeding.

10.2 Arbitration Agreement

Except for certain kinds of disputes described in this Arbitration Agreement, you and Infinishot AI agree that any disputes related to these Terms or the use of the Service will be resolved by binding, individual arbitration. You and Infinishot AI agree to give up the right to go to court to assert or defend your rights under this contract, except for matters that can be taken to small claims court.

10.3 Arbitration Procedures

The American Arbitration Association (AAA) will administer the arbitration under its Consumer Arbitration Rules. The arbitration will be held in the United States county where you live or work, in San Francisco, California, or any other location we agree to.

10.4 Exceptions

Both you and Infinishot AI retain the right to bring an individual action in small claims court and to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights.

11. Miscellaneous

11.1 Changes to Terms

Infinishot AI reserves the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on our website. You are advised to review these Terms periodically for any changes. Changes to these Terms are effective when they are posted on this page. Your continued use of the Service after any changes are posted constitutes your acceptance of the new Terms.

11.2 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

11.3 Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions will continue to be in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding the Service.
